Ninth Circuit Says Airbnb and Others Must Deal With Registered Properties Only

The US Court of Appeals for the Ninth Circuit upheld Santa Monica’s Home-Sharing Ordinance stating that Airbnb and Homeaway.com must deal only with licensed properties.

Santa Monica’s regulation says it allows residents to invite visitors into their homes for profit when a resident is present and possesses a City business license. Airbnb and Homeaway argued that they could deal with unlicensed properties.

Los Angeles’s new ordinance went into effect 1 July. It says that an owner must live on the property being rented and property must be registered with the City. One can only rent the property for 120 days out of the year also.
